Terms and Conditions
General Terms and Conditions (GTC) of the platform foodfluencer.me
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between the sole proprietorship "foodfluencer, M.Sc. Markus Pangerl, Lenaustr. 1, 81373 Munich" (hereinafter "Provider") and the registered users of the platform foodfluencer.me (hereinafter "User"), insofar as these are entrepreneurs within the meaning of § 14 BGB. Consumers within the meaning of § 13 BGB are excluded from use.
2. Subject of Contract
(1) The Provider provides a digital platform that serves to establish contact between gastronomic businesses (hereinafter "Restaurants") and Influencers.
(2) The Provider acts solely as an intermediary and does not become a party to any agreements concluded between Users.
3. Registration and Contract Conclusion
(1) Registration with truthful information is required to use the platform.
(2) A usage contract is concluded upon completion of the registration process and confirmation of these GTC.
4. Provider Services
(1) The Provider provides a technical infrastructure through which Users can create profiles, find each other, and make contact.
(2) The Provider does not owe any successful mediation. The decision to collaborate lies solely with the Users.
(3) A rating system may be provided in the future without any entitlement to it.
5. User Obligations
(1) Users are obliged to provide only truthful information and not to create fake profiles.
(2) Users bear sole responsibility for all content they provide through the platform.
6. Fees and Payment Terms
(1) Restaurants pay a monthly fee of EUR 49.00 net.
(2) Influencers pay a monthly fee of EUR 9.90 gross.
(3) The first month is free for both user groups (trial month). Thereafter, the subscription renews monthly and can be cancelled at any time at the end of the month.
(4) Fees are due in advance. Payments are processed through the payment services integrated by the Provider.
7. Contract Duration and Termination
(1) The contract runs for an indefinite period and can be terminated by either party with one day's notice at the end of the month.
(2) When booking an annual subscription, ordinary termination is only possible at the end of the agreed term.
8. Liability and Indemnification
(1) The Provider is not liable for User content, for the fulfillment of contracts between Users, or for any damages arising from such contractual relationships.
(2) Users indemnify the Provider against all third-party claims resulting from any contractual or unlawful use of the platform.
9. Availability
The Provider strives for uninterrupted availability of the platform but cannot exclude downtime due to maintenance, further development, or technical disruptions.
10. Data Protection
The Provider processes personal data of Users in accordance with the applicable General Data Protection Regulation (GDPR). Details can be found in the privacy policy on the website.
11. Use of Third Parties
The Provider uses the following third parties to deliver its services:
Supabase (data hosting in the EU)
Mailchimp (communication)
Stripe (payment processing)
12. Final Provisions
(1) German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is the Provider's registered office, provided the User is a merchant.
(3) Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
13. Amendment of GTC
The Provider reserves the right to amend these GTC at any time with effect for the future. Users will be informed in good time by email. If the User does not object to the amendment within 14 days, the new GTC shall be deemed accepted.
14. Blocking of Users / Termination for Cause
The Provider is entitled to temporarily or permanently block user accounts in the event of a violation of these GTC, applicable law, or in the event of a justified suspicion of misuse, or to terminate the usage contract for cause.
15. Copyrights / Usage Rights
The platform and its content are protected by copyright. Users may not use, reproduce, or distribute content that violates the rights of third parties.
16. Technical Requirements
Users are responsible for providing the technical requirements for using the platform. This includes in particular an internet connection, current browser software, and email programs if applicable.
17. Electronic Communication
The User agrees that contract-related communications, notices, invoices, and information may be provided in electronic form, in particular by email.
